Is it 30 day or 60 day notice?


Okay, me and my boyfriend live in an apartment community in Oklahoma and our lease will be up June 17th, 2007. A few months ago we went to the office to ask about how much notice we have to give and one of the leasing agents told us to give a 30 day notice. So then we came in right at the 30 days to give them the notice and it turns out they actually require a 60 day notice. The manager refused to honor the fact that her leasing agent had told us 30 days, and she said that in our lease agreement it stated that they need a 60 day notice. Are they allowed to do that? Is there any state laws or anything that govern how much of a notice I am actually required to give? And are they required to honor things they tell me? Please Help!!!

Every state will have a law in regards to tenancy and I would ask managment to show you the law requiring 60 day's notice.

Perhaps there may be a legal hotline where you can address this issue or perhaps another rental manager may be able to clarify the required period for notice.

The written lease will usually win. UNLESS Oklahoma law specifically states a time period.

If the leasing agent acknowledges the statement, the manager "should" honor it.

Everything you stated is hearsay "she said, he said" have you read your lease agreement? What does it really say? In any event here are the laws you requested

if its stated in ur lease then u need to follow the guidelines of your lease. its in writing, u signed it, dont go by what other people tell u, read ur lease thats the only way you will know for sure.

I agree....you will need to comb through your lease agreement, if it says 60 days, that is what will stand. A verbal agreement cannot supercede a written agreement. However, you should also review Oklahoma tenant law and see what it says. This may help.
