I live in a large apt. community that susposeably runs credit/background checks on all adult residents However


The office staff is very chatty about other residents business and I found out that some of the apt are rented by and paid for by a company and that comp. has whoever living in the units. The people are all Mexican/spanish speaking men! They live 6 to a two bedroom. Our lease clearly states that all residents must be checked out. Could we break our lease due to the nonchecking of others? This isn't the first time this has happened either, last year we found a child molester here! They kicked him out two months later. There also is a convicted felon living in the apts now, but will soon be leaving. The lease agreement stated anyone with a sexual or violent felonious past is not permitted to lease. What to do??

A lease is a contract and if they've breached specifics of the contract, you could very well be able to get out of the lease. If these are just "rules" that are posted (and not specifically part of the lease contract), then you probably would have to wait for the lease to expire.

Since you say "the lease clearly states that all residents....", the company that is renting the apartment (probably for illegal aliens) seems to be breaking their lease agreement, at the risk of your safety. You may be able get that company's lease terminated or be allowed out of yours.

If you can prove a pattern of the landlord not enforcing provisions of other leases, a judge would probably find in your favor.

My recommendation would be to contact the local HUD office or a real estate attorney and show them the lease.

you are pretty much sol. you cannot break your lease without a penalty but you could report he apt community to the better business bureau or whatever organization oversees landlords in your area. they technically are not doing anything wrong. they are checking the lessee. maybe you should stop wasting your money by renting and buy your own home that way you cannot ***** about what is going on around you.
