Landlord legal help please?


I have been having problems with my landlord. He seems to be holding a feeling of resentment against me for making him make some repairs he did not feel were necessary. The last time I went to the office to make a request for a work order we got into an argument and we both got very loud (loud voices only no bad words or violence).

Yesterday I got a letter from a law firm stating that I need to be out of my apartment with in 5 days of the date marked on the letter. The letter was sent regular snail mail with no form of delivery confirmation, and was dated Oct 14th. So it essentially says I need to be out on 2 days notice. I have a one year lease, and as far as I am concerned I have done nothing to violate it.

I contacted the law firm and they said I am being asked to leave because the landlord fears for his well being when around me. Yet 40 minutes after this argument we had he came to fix my dishwasher. So I don鈥檛 see why he would have done this if he was so scared, I would also like to point out that the only threat that was made in our argument was by him when he told me I would be out of here if I kept complaining about things in my apartment.

I have no desire to stay in a place I am not wanted and have started to look for a new place. However this takes time as there are wait lists and other factors involved in moving into a new place. So I need more then 5 days for sure. I would also like to note that in this letter I received from the law firm it states I will have to pay the break lease fee. Yet just two moths ago I got a letter from my landlord stating they would release me from my lease at anytime with 30 days notice. So would this get out of lease letter still be valid now? (it has no deadline stated)

Is there anyway I could go about dealing with this with out having to get a lawyer, and going to court. The landlord has the property company to pay his legal bills I have to pay mine out of pocket. I do want to move I just need time.

Any suggestions would be very much appreciated

Dude I wouldn't move at all. I would tell him I have no intention to move and if he wants you out then he will have to get the Police involved.

Just because his lawyer drafts some papers doesn't mean you have to move. There are legitimate dead beats all over this country and is a very diffucult task to get them out. the eviction process in some cities can take months. As for this a-hole he sounds like he has no grounds to remove you so don't budge.

Worse case senario is he has the locks changed where as you now have to get the police involved and now he is some serious trouble. Trust me this guy is blowing smoke up your *** he has no grounds to remove you STAY PUT!

First, all places have different rules and regulations when it comes to renting and since I don't know where your from I can't give you specific info on your situation. But if you search you should be able to find a website that lists the legal aspect. Also there is usually an office that can answer your questions if you can find the phone number (read free legal advise).

Second I'm not sure but I don't trust the letter you received. I'd check out the law firm. Most legal documents go certified mail and are only valid if signed for. Otherwise you can claim you never received the notice. And I have a feeling the 5 days from date of notice is bs. Would be easy enough for the landlord to print a notice on his computer and mail it off.

Third, call your landlord. Apologize and ask for a couple weeks to find a new place. See if he's willing to work with you, never know he might.

Forth, get the heck out of there.

Also look into a weekly rental place or a hotel that offers weekly rentals.

tell the landlord to go f.u.c.k himself and take your to court, let him evict you that takes time, and when your in front of the judge tell him everything you said here.
