Is there anything I can do to prevent being evicted?


My wife and I, along with our 3 year old daughter, have been living in our current apartment complex for almost 2 years in North Carolina. My wife recently started a new job and she had to take a cut in pay and hours temporarily until her training period is up. Well, our landlord just happened to walk into the place where she works and wanted to know why we hadn't informed him that she had a new job. She told him that she had just started and just hadn't had a chance to come by his office. He said that we need to come by next week to "recertify" our lease, which isn't due to expire until July 2007. Well, after some calcuations, I found out that my wife isn't currently making enough money to satisfy recertification, since he said that he's not allowed to take more than 41% of our income. Because of this, I am extremely worried that he will attempt to evict us and we have no where else to go. I'm not sure he will care that my wife's hours are only temporary. What should we do?

Just to clarify some things. 1) I can't get a job because my wife works and goes to school and there has to be someone at home to watch our daughter. 2) It's not that we can't pay the rent. It's the guidelines that the landlord has to go by...our apartment complex is governed by FHA. 3) If I'm not mistaken, this apartment complex is considered a "HUD" complex.

why dont u get a job?

I don't think it's any of your landlord's business if you or your wife get a new job or get more money, or less money. That's really personal and it's really none of his business. Do you also have to inform him everytime you go poopy? Did you have to give him a blood and urine sample just to get your apartment? lol

Is there any way you could ask for a raise at your job? Maybe the Dept. of Soc. Svcs. can help you thru a HUD program.

You don't have to "recertify" anything. You qualified when you signed the lease, you are paying your rent on time now. That's all he needs to know.

Another thing, it doesn't matter what's in your lease. A lease cannot go against the legal code. You cannot be made to sign rights away in a lease.

I am so sick and tired of people using their children as an excuse not to work! There's this neat little thing called day care have you heard of it?

You must feel like a "real man" sitting at home on your *** while your wife has to go out and support the family. There is NO reason other than just being plan lazy that you can not work. Get a job working the hours that your wife is not in school in at work. Stop relying on government resources to get by.
