I think that my Apartment manager is harrassing me...? |
ok i have been living her for almost 2months. we moved in in the middle of july, and we were supposed to get the first month free, but the manager said that we had to pay for the 2 weeks on the 1st of august. We were like what? i mean we had just moved here from las vegas and barely started our jobs, we were kind of out of money. No one got paid until the 15th of augs. we some how got the money together, but it was like a week late. Anyway the manager made up these rules about our kids not allowed to play outside, without an adult. we ignored it and got a lease violation. Today the kids came home from school and my sister was outside getting them from the bus. they were still out side and she went to go check the mail, the kids still in sight. Some one called the office and said that the kids threw a rock and broke a window. my sister went to the office and was like hey i have been out here with them and they didnt do it. there was also an issue with the company vehicle we had ours in front of the apt. and she said that we had until mon. to remove it or it would get towed. we agreed, but there are about 14 other company trucks out there still and nothing has been done about theirs. anywho she told me that if i dont take my name off the lease that we will be getting evicted soon and that she just wanted to let me know so that my credit doesnt get messed up. she is really rude and doesnt even listen to anything we say. it has been a month since i asked her to fix somethings in the apt. nothing has happened. she gave us another lease violation paper, and she said that no one was watching the kids, even though my sister was out there. what do i do? is this legal?? i know that i cant keep 9 year old twin boys in the house all day.. what should i do?!?! Sounds like you have a lease. Did you read it? Your financial situation is really no concern or your manager other then you have the ability to pay the rent when due and follow the rules set up in your lease. if you have no lease I would find another place, you dont need to put up with that BS and if is happening now its just gonna get worse. Gee, sounds like she just wants you to obey the rules, just like all other apartments Pay your rent on time and watch you kids at all times. Or speak with your neighbors who are obviously being annoyed by your kids and reporting you. Go to the cops and report his ***! You don't have to deal with that kind of ****! wow, imagine someone expecting you to watch your kids when they are outside. The nerve! Ask that manager to show you the stipulations and as for the for window demand to see the accuser. Check your lease agreement for clauses pertaining to children. Also check your local government for any landlord-tenant association that can mediate any problems you have. Everything you name here is a valid apartment complex rule, and you admit that you ignore the rules. Either move somewhere else or deal with it. I don't see any harassment. Read the agreement you signed. Saying kids can't be outside sounds like b.s. to me. See if it is listed somehwere on something you signed, or if it is in the written rules you agreed to when you signed your lease. Usually, there can be rules such as, "no kids in pool area", or no people in a certain area after a certain time, but they can not impose 'curfews' and such on you, which restrict your basic freedoms. Children are allowed to do things, and playing outside is (I would think) ok. I had a landlord like than in Sand Diego, a guy, he even hit on the wife. After I made bail the cops told me he didn't wake up for 6 hours. Other tenants I didn't even know filed police reports that he attacked me first. Never even went to trial and when I filed a lawsuit against the owners the sucker lost the free apartment and got fired. Well for one thing, if your name is on the lease she really can't tell you to take your name off. Two you can go to the court house and petition the general district court and have them keep the rent money in escrow until she fixes what you need if that is in the rental agreement. If you really want evidence that there is harrasment going on then videotape your kids playing up until she complains on them for nothing. Do that a couple of times and file a civil suit against her. I don't know what state you are in but the above is legal in virginia. Try to keep your kids in for a little while, and start looking for another place to live.. maybe things will settle down and you can stay.. Keep a journal of what is happening.
