What do I do if I'm being taken to court by my landlord for monies I don't owe?


I was renewing my lease at my complex, and I was supposedly moving into a renovated unit. I tried to view it before I moved, and was told it was still under construction, and could not see it until finished. It did not finish until my moving day, and I had to move, it was down to the wire. Paid a 200.00 deposit, and was not happy with what I saw. Went right back to the office and refused to move in there. I had to wait all weekend with packed up boxes to talk to a manager, and after all that, I ended up just staying in my current unit. When I tried to retrieve my deposit, since I did not move, I was told they posted the check anyway! I was able to put a stop payment on it, so now they are trying to take me to court over it. They knew the same day I wrote the check, I was not moving into that apartment, but cashed it anyway, and is trying to evict me for money I didn't owe in the first place. What do I do?

They are trying to evict you - that's the problem. You should try to settle the case so they drop the eviction proceedings. Make sure everything is in writing and signed before you pay them anything. Get yourself an attorney to make sure you aren't doing it wrong.

A judge probably won't evict you as long as you are paying rent on your current apartment - but you will probably have a judgment against you. You will probably have to pay a month's rent for the other apartment because you cost them a month of rent by not renting the new apartment (that they could have had rented out already). You might also be "holding over" in your apartment. This means - because you stayed in your apartment - the person who was supposed to move into your apartment couldn't take possession. That was really a bad thing to do to the person who had rented your apartment.

go to court and prove you dont owe it! Its only 200 bucks, let the judge decide!

When you moved in. you took possesion of the unit. THerefore the contract is completed. I would suspect you will lose a court case
