Can I sue a office building parking lot if I am not at fault? |
I was backing into a parking space in a office building and I did not notice their was one of those wall mounted storage spaces and the top of my car went under it and the top of my car has 4 deeps scratches.... can I get them to pay for these damages? No you can't sue. What are you going to sue for? The fact you were inattentive while backing and struck a fixed object? That's like asking if you can sue the city b/c you hit a tree you didn't see. If anything the building owners can sue you for any damage you may have caused their structure. no they have signs all over the place just for that reason So.. let me get this straight... you backed into a fixed object.. that was there to be seen.... and you want the building that owned the parking lot to pay for it? So how are you not at fault? It was there... you backed into it. You are at fault. Not noticing a stationary object is negligence on your part. You can't give a ticket to a storage space. You were at fault, you didn't see the mounted storage area. Your insurance will likely cover your damages, if your carry comp/coll coverage. If you were in a parking garage, and it rained, and the concrete leeched lye or acidic substances on your car, ruining your paint job, the owner's of the parking facility would be responsible for your damages, as you would not be required to assume the concrete would leech chemicals. It all comes down to common sense. |
