My husband and I are having problems who will my share of the house go to?

My husband told me he does not love me anymore for a long time. He also hates my son who just turned 18. He is working and graduated and works hard hour all night for 12 hours 5 days, It so hot today he worked 20 hours and only has 4 hours to sleep until work again so I let him put in the A/C unit in his room and he agreed to pay us for it. My husband comes home and freaks out does not want the money wants him out and me if he could however, this house is in my name to. The problem is we both had houses when we met and somehow because his was bigger we sold mine to cheap to fast because he was in a hurry to get rid of it. I lost out because 3 months later the house was worth 100,000 more, Now my lawyer says I would only get a helf of the money for the house for the time I live here 4 years. He also said I could not leave my share to my kids when I die it will go to him and that Ok I want him to have it and after his death then to both our kids, Is this true? I screwed? I scared?

You need to see an attorney and set up a trust or will if you want your share to go to your son, upon your death with the survival of your spouse. If your husband dies first, it will all automatically revert to you without a will.

Honey, get a new lawyer, NOW! Even in non-community property states, by United States Federal Law the marital assets are divided 50/50, most are sold, including the home shared and each gets half the money, money they can do whatever they want to with. Your lawyer is either a secret friend of your husband's or a flat out idiot!

Yes that is true. He also gets half of your pension/retirement plan. It sounds crazy but your lawyer is right.

My advice is to forget the money and move on with your life. Find a man who loves you.

When legally married and one spouse dies...everything goes to the other spouse unless other arrangements are made in a will.

Find another lawyer.

I was once in a situation close to this. The person I was dating was eagered to have me sell my property and invest the money into a home of our own. I did not do this. Today marriages are not promised. One year later we separated and broke off the engagement. I was quite thankful!!

Your son is 18 yo. It may be time for him to get his own place. If he has a job that pays good money then having his own place would not be so bad. If you think he is not ready for this and needs to save a little more money then together with your son and husband, come up with a game plan on when the child will leave the home.

As for you, if you are ready to leave your husband then yes, the house can be sold and/or you can fight for it in alimony. It will pretty much be a fight to prove that you sold your home because of the agreement to live in his as both of yours.

You need a new lawyer,if youre divorced its up to you where your money goes UNLESS your kids are underage and hes the responsible party for them.However when my fiancees mother passed away she had her brother as the trustee (to make sure the money goes where it belongs) but my fiancees dad got her social security to take care of the kids that were underage.but the rest of her money went to her brother to be disbursed the way she wanted it.Had the boys not lived with theyre dad,he wouldve had to send the social security money to the person whom had guardianship
