Should I have a Union Representive presents before answering any questions?


Two weeks ago a little boy fell and slipped on beer. It was really busy and I called debbi in the office and told her I need someone to clean it up. She misunderstood me and thought I said bayer instead of beer. The couple with the son called today, I'm guessing their perparing a lawsuite. I sign in the break room says that I have the right to have a Union Rep present and if my demand is not meet, then I refuse to submit to this interigation because I fear severe dicipline or termination of my employment. Do you think I should have a Union Rep present or is it safe just to explain what happened?

Again, insist your union representative is fully aware of your account of the incident in advance of the meeting with the representatives of management.

In fact, your union contract with the employer outlines specific guidelines & procedures for exactly this type of dispute resolution; further, an outside attorney specializing in employment law cannot step into the matter, officially, until all procedures written into the union contract have been exhausted.

Any disciplinary action toward you the employee, or legal action towards the employer will benefit by having the incident & subsequent investigation documented in the collective bargaining (union) arena.

It is never safe to speak without an appropriate advocate on any matter which may result in litigation or discipline/termination of employment.

Lawyers are expert at getting you to say something that can make it all your fault. Don't go without your union rep. You may feel it would cast you in a bad light, but lawyers are always looking to get you and the store.
