How to motion for a new judge in divorce custody case?


Whats the process when you are getting the bad end of a stick by a judge who seems biased somehow towards the other side.

I had an attorney, who basically took my money and ran.
He left the day of our first temporary hearing.
10 minutes before we were to go to trial, and because I refused to settle for what other side was offering -- and I was very confident we would win our arguement....my attorney said he wouldnt help me.

Its because my attorney never ordered the subpoenas I requested.
NEver once met with me to discuss strategy.
My attorney was so intent on settling that he never bothered to actually prepare to fight.

BUT - what he did was run into the judges chambers right before the judge was going to call our case - we were next.
He ran in with the opposing lawyer and they both left me outside, while all 3 went into a closed room.

Judge came out, my lawyer asked for a motion to withdrawal.
They froze all my assets and gave temporary custody to my daughter in 10 seconds....

Now, it appears that the judge has such a negative opinion of me, because my lawyer said whatever he said that I dont know.

And even though I am the one not lying, not doing inappropriate things, the one that looks forward to bringing out the truth in everything.....

This particualr judge seems to throw out everything.

I have actual recordings of my wife lying to everyone.
My wife took my daughter out of state after confessing on my tapes that she cant take care of our child.

Without tellingme - I find out my daughter was taken out of state.

I dont think Im going to get a fair deal with this judge.
Anyone know process on how to motion for a new judge?

Having a judge removed from a case is pretty difficult if you are in a small city or county. You need to find a new attorney.

In general unless you can show bias or conflict you will not be able to have the judge removed, also my guess you are going pro-se at this point?

Without knowing all the facts/ state: the tapes might not be admissible or even material to divorce case

The procedure for seeking recusal is different in every state. In some states, you can get a new judge (once) in a civil case just by paying money and making the request. In my state, you can file a motion for recusal alleging actual bias and that motion will be heard by another judge. However, unfavorable rulings do not demonstrate bias and knowledge properly acquired is not grounds for disqualification.
