Visitation transportation question?

Well I'm not going to go into the entore story because there isn't enough room, but I live in Ohio. My ex didn't see my daughter for 2 years and got arrested for not paying child support last year and he used his time to get an appointed lawyer and accused me of "not letting him see her" then he asked for visitation since they were making him pay child support. Now I have to drive about an hour and a half with my daughter to meet him in Mansfield every other week since he lives in Columbus (about 3 hours from here). I simply cannot afford this anymore. The gas prices are high, my bills are high and the rent is high. On top of that I have another kid with my boyfriend and one on the way. So expenses are pretty high for us.
The last week we couldn't make it down there because of gas.. and this week, once again we just cannot afford it. I have to tell him I can't come down this week, again. Can he do anything to get me in trouble? And is there a way I can bring this back in court?

There really wasn't enough room to get all the info I needed for you to get a better idea, but basically, I got a crappy lawyer for this case and he took my ex's side. Even though I have been there for my daughter and I have made it VERY easy for him to see her... he made excuses and lies for himself so he wouldn't look bad. I feel that since he was the one who was absent for most of her life, HE should make more of the effort. Things shouldn't be made easier on him. He resently got sentenced to 2 years of "Community Control" (whatever that means) for not paying CS and I was wondering if he can take action even though it is IMPOSSIBLE for me to come down there yet again this week.

Laws vary from state to state but in general child support and child custody are seen as two separate things as far as a court is concerned. Just as you can 'force' the issue of suppport he can 'force' the issue on visitation. If you do not hold up your end of the visitation agreement he can take you back to court and you could possibly be found in contempt.

I think it will depend on your state laws. I know in some states that if you refuse to bring the child for visitation that he has the right to refuse to pay the child support as you deny him the right to see his daughter. But, he is not really helping you anyway.
