What happens if they cant find you?

I am adopting a little boy and his court date came in registered mail today BUT his previous legal guardian was abusive to him and will get the same letter and I do not want her to come for obvious reasons. I know for a fact she has moved and not left a forwarding address. What will happen to her letter ours came to our house with the postman and we had to sign for it. What will happen to hers? If they cannot find her will she just not get it? I am hoping she does not show up anyway he saw an old babysitteer and went beserk because of the memories. He is not coming but may have a hard time being civil knowing what she did to him. It is unforgivable.

He will be 3 soon and I am trying to find out wether he has to be there or not. I hope not.

i think the state is required to follow certain procedures in giving the legal custodian the right to attend the hearing. In doing so, they send letters and in most states there are a few ads placed in the newspaper telling them that their rights will be forfeited unless they respond. hopefully, the creep won't show their face and you and the child will be free to make a new and better staret. bless you both

They can only ATTEMPT notification. If notification can be proven to be attempted but not successful, then that's all they can do. Her's will be returned because she did not sign to receive it. End of story.

If no one can find her, of course they won't be able to deliver mail to her. They aren't going to patrol the neighborhood in a helicopter bearing an informative banner for her benefit.

The former legal guardian has rights--namely, to a fair legal hearing if she hasn't had one already--but most of these affairs can be structured for the benefit of the child. Find a legal children's advocate if the boy doesn't already have one, and ask if the court can be closed. If the former guardian needs to be present in the proceedings, ask if the boy may be removed before she's admitted, and brought back when she's gone. If a psychologist or social worker says it's best for the child not to run into the old guardian, they should be able to arrange the court date so the two don't need to be in the same room at the same time.
