Is there a statute of limitations on collection for a bad debt? |
My husband received a letter today from a collection agency stating he owes almost $400 on an account from 2000-2001. He states he has no idea about it. We called the agency and they say that they were unable to locate him all this time until now (regardless of mail forwarding and address change with the credit bureaus.) Now 7-8 years later and they want to collect, and we're supposed to take their word for it that the account is real. Regardless, isn't there some kind of age limit on collecting on old (alleged) accounts? Thanks! Depending on where the account was openend, it may or may not have passed the statute of limitations. Even the most aggressive states have a cap of 7 years for collection of a debt. Send the agency a letter stating you do not want them to contact you again and if they do, it is a violation of the Fair Debt Collections Practices Act. Hi, Not sure if there's a statute of limitations. Does he recognize the collector? Has this debt been on your credit report? If it was on your credit report, then it shoould fell off now (bad credit marks remain on your record for 7 years). |
