Attorney doesn't respond and lawsuit isn't moving forward?


I am in the process of suing my neighbor for nuisance. He has been harassing me for two years, he has diminished my property value, I can鈥檛 see any peace in my home whatsoever, my neighbors are also affected and are willing to testify on my behalf. Here is the problem. My case was filed in Jan 07 and since then I have shelled out 7,000 in legal fees, and my lawyer STILL hasn鈥檛 asked for an injunction.

When I send him e-mails he doesn鈥檛 respond, when I call he鈥檚 鈥渙n the other line鈥? and on the rare occasion that I do get in to see him he always says 鈥淚鈥檒l be doing that in a couple of weeks鈥? Naturally a couple of weeks pass, nothing is done, and I鈥檓 right back where I started with the non-communication. It wouldn鈥檛 be hard to ask the judge to grant a temporary injunction in my case but he just won鈥檛 do it. Did I mention that we haven鈥檛 even had a scheduling conference yet and it鈥檚 been a year and a half since I filed? What should I do?

Sometimes lawyers take on a bigger case load than they can really handle - and that sounds like what your lawyer is doing. It's a sign of an attorney who is very disorganized, and is routinely ill-prepared for court.

This isn't necessarily serious enough to report to your state bar. In order for you attorney to get in trouble with them he would have had to cause sufficient damages to you by neglecting his fiduciary duties. I would do fire him as your attorney, and seek new representation.

Consider sueing your attorney or do you really have a case and is he just taking your money.

Circumvent your lazy lawyer and file a complaint yourself with the court.

Get a new lawyer. $7000 and he hasn't done a thing for you.
