Canadian Law??


Ok I've got a question I'm hoping will be relatively easy to answer regarding divorce law in Canada.

Here's the basics:

Hopefully soon to be EX hubby is in ontario. I reside in new brunswick. 2 minor children, for which custody has been dealt with (courts ordered I have custody, him no visitation due to abuse of children.) due to his said abuse at the time of custody, no child support order was made.
Since then, he won 1.35 million in lotto 6/49 (his share....altogether 10.8 million was won) He has never stepped forward to offer any support for these children. Although now he is attempting to file for a "simple" divorce in ont. meaning no financial info is shared between us. Since he attempted to serve me through court documents sent through unregistered mail, that had to be forwarded & reforwarded I know that I have been improperly served, and am refusing to acknowledge receipt of documents. Now he has a paralegal calling my parents home (where i havent resided in 20 years)

Given these circumstances, what rights do I have? I want to be sure the rights for child support are preserved, don't want anything to be done in my abcense (sp?) and would rather travel to ont & appear before a judge if that means the kids get support. Money is tight, and really looking for suggestions that I can attempt on my own before hiring a lawyer.

The amount of child support that he has to pay is based on his income and the number of children. The federal government has established the guidelines and they are available on line. The fact that he does not have visitation rights is irrelevant. I would get a lawyer and find out for sure if he will have to pay support. I can't imagine why he would not.

You REALLY need to talk to a lawyer. You are entitled to half I believe.

hire an attorney immediately....
your children and you deserve money as well..
