Suing for Wrongful Termination, what are my chances of winning? |
I was told I was not allowed to hire black people and I refused to not hire black people just for being black and told my company it was illegal to ask me to do so (I was the HR director at my company) I was only employed for 3 weeks. Company found out my boyfriend was black and I was pulled into the conference room as was told that I was not a good fit for the company and was terminated. I am suing for wrongful termination, but the company kept all my evidence (notes I had made in a notebook in regards to being told not to hire black people). company had over 125 employees in california and had no african american employees, only Asian and white employees. I did not know the makeup of the company (nor did I ask) when I was hired They could not have fired you just because your boyfriend is black. If that is the case, you have a good chance of winning. However, if it was a small company with less than a certain number of employees they do not fall under EEOC guidelines. This is December 7th, 2007. I do not beleive than a company is stupid enough to refuse to hire anyone because of their race or ethnicity. There must be something more to this. You need wittnesses and others who experianced same thing to prove it or its you said they say. Contact the Better Business Bureau and the ACLU. If you make it a your word against theirs, you will most likely loose. However, if you build your case indirectly on evidence that supports your claims you wil have a good chance. Questions like - What percentage of the companies employees are black? Are other minority groups disproportionately represented? Of the Black employees on staff, what level of employment do they hold? Are their any Black managers, supervisors, Board Members? What was the official reason for termination? Do they have evidence to support their reason for termination? Does your past work history support their position or your position of being a good worker? If you uncover that data and it supports an argument that discrimination exists within te company, then your word will be believed over theirs and your chances will improve. Also, that sort of data may enable you to obtain representation from political group. In that case you may be offered a settlement without going to court. I'm sorry this is happening to you. |

I'd average the top n scores for each person. If a person doesn't get rated n times, they get zeros for their missing scores. I'd use n=15 because it's 10% of your employees, ...
