Value Added Tax on Lease of Commercial Space? |
If the contract of lease for a commercial space is silent on the issue of value added tax, what is the tax responsibility of the lessor ? lessee ? The lessor is responsible for the value added tax based on the monthly lease amount. The seller/lessor is the one statutorily liable for the payment of the tax but the amount of the tax may be shifted or passed on to the buyer, transferee or lessee of the goods, properties or services. In your case, if the contract is silent, you may assume that it is already VAT Inclusive, and you may claim the input VAT. To be sure, you may check the official receipt or invoice issued to you for any VAT amount or if the lessor is VAT registered. But the best thing would be to ask your lessor directly. |
