How do I go about negotiating a commercial triple net lease?


I am doing research for a non-profit that is preparing to lease commercial space within a San Diego, CA strip mall. We're new to this and have been given an opportunity to submit a counter proposal. We would like to address the price per square foot. Any help is appreciated.

That's one issue, but if you're new to it, chances are you don't really understand the lease, so you should hire a business/RE attorney to review and negotiate the lease. The $500-1000 spent should pay for itself in lease improvements, peace of mind, and avoiding future legal issues.

I do this for a living, I work for a large retailer and I lease shop spaces to tenants. Here are some ideas to counter offer at:

* Definitely counter offer and reduce the rent. The landlord always starts high in their negotiations.

* Tell them you want a "gross" lease which means you do not have to pay a portion of the common area maintenance costs or property taxes.

* Ask the Landlord to give you some free rent at the beginning, maybe 3 months or so of free rent.

* If you are going to make any improvements to the building, ask the Landlord to contribute towards the improvement costs, maybe $5.00/square foot.

If the space you're trying to lease is in high demand then you probably wont have much negotiating power but if it's been vacant for a long time, you should get what you ask for within reason.
