What to do re: a Hit & Run accident???


I drive a motorcycle and on 6/30/08 I was on the freeway and was hit by someone trying to illegaly change lanes, well more of a dangerous attempt to change lanes.

Anyhow as I managed to not steer straight into the rail and possibly die... I slowed down and pulled over, the car noticing I had pulled over decided to speed off and left.

Fortunately for me there was a witness who took down all the information and was able to provide correct information to the police for the police report. Now a police report was made and filed as a hit and run.

After attempting to contact the man who hit me... he has avoided all my calls and so I decided to handle it straight through my insurance through my uninsured motorist coverage... but it didn't exactly cover all my expenses to fix the bike.

Now is there anything I can do on my part..... like sue the guy or just let the insurance handle it??

i am wondering who you are insured with? THEY should be trying to contact this person and his insurance company. (if he has any) why did they not cover to fix the bike? when you file a loss on your policy, your company should pay your claim AND then try to subrogate back to the at fault party. call your company and find out if they are doing this. if they are not FIND A NEW COMPANY. this is what you pay them for. if your company is not going to help you, then you can try to sue him. even if you took him to court and won, you may never get anything from him. if he left the scene thats a good sign he is not insured and has nothing to sue him for.

You could absolutely sue the guy to cover the rest of the expenses. I'm kinda surprised the police haven't charged him with anything since leaving the scene of an accident is a pretty serious crime...

The insurance company should be going after the guy as we speak. Surely they are going to try to collect from the guy so they can get some of their money back? If they aren't going after him, you certainly can........ and should

I would ask the police to find out where he lives and try to work it out with the driver. Hope this helps. Good Luck.
