BofA CC Co. is not cooperating and returning my calls for a fraud/id theft case. $14,500 involved.

Bank of America is not returning my calls regarding a fraud/stolen id case where a criminal stole my id and transferred $10,000 to another account bearing my name in a different bank, still managed by him. I had no idea until i checked my credit report which showed that BofA issued a cc under my name and the limit of $12,500 has been exceeded, to the tune of $14,500 including a bank transfer of $10,000. After "investigation" the bank found me responsible for the amount. I have received a bill from BofA credit card for $14,500 with interest charges, etc. The investigator has not responded to my phone calls, even though she has given me a phone number and her voice mail says she will return calls within 24 hours. Left three messages and she has not responded. I heard bad stories about BofA credit card company and their inefficiencies in handling such cases and helping the vicitims and trying to catch the culprits. Any advice would be helpful.

There is a specific procedure that you must follow in the event of ID Theft.

1) File a police report
2) Notify the credit bureau of ID Theft
3) Send a signed and notarized affidavit to the creditor informing him that you are a victim if ID Theft, and that if they insist on holding you responsible they MUST supply you with validation for the debt. That includes a signed contract, copies of bills and receipts, and everything used to calculate what they claim you owe.

Send all of these letters by certified mail/return receipt, and give them 30 days to prove their case.

VERY IMPORTANT! You MUST dispute this with the credit bureau as ID Theft.

If they don't respond or drop this from your report, contact an attorney and file a lawsuit. You will win a few thousand for your troubles. If you follow the above procedures, they will be in willful non-compliance with the FCRA laws.

I'm unsure how to handle a fraud/ID theft situation.

But if you have issues with a company, in this case BOA contact he better business bureau.
