(GRAND LARCENY-3RD E Felony) not gulity?

On the night of 5/22/08 my brother the defendant was hanging out with friends at a Bar on 2nd Ave and 52st. Walking out with his friends they saw 3 girls arguing with a bouncer, stop to watch how the girls were getting kick out off the Bar for over limit drinking. The intoxicated girl was carry out by the bouncer and she was screaming at him for the way he had treating her. Since she was under the influence she was acting sloppy and her friends were still arguing with the bouncer. Her shoes were on the side he helped her put herself together and picked up the bag along with her shoes to handle it to her . The bouncer said to the girl look " His steeling your bag" the bouncer then calls the cops. When the cops arrive they didn't hear my brother story or his 3 other friends. The girl who press charges was "really drunk" accruing to the defendant and his 3 witness. They also stated that the bouncer said " his steeling your bag" because he didn't want the girls to call the cops on him for roughly treating the over intoxicated girl. My brother is being charge for 155.30 FE (GRAND LARCENY-3RD E Felony)
I felony is a outrageous charge for this case. He was suppose to be out on bail $3000 but he had a warrant for not appearing in court for orange county. Since its memorial day weekend he has to wait till Tuesday and see what orange county wants to do in regards to him. The court appearance in orange county is for speeding tickets. I understand that its two separate cases butI'm most concern in regards to the 5/22/08 arrest charges.

At this particular stage there is not much you can do. He needs to see the judge first and be arraigned. Often in cases like this where the witnesses are not very reliable, the D.A. decides not to proceed with the case so first we need to see if he is arraigned on the charge.
If he is arraigned, you are going to want to gather witness statements from your brothers friends who were with him and can confirm his story. Of course, this sounds like it will turn into one of those "he said, she said" type cases. Unfortunately, your brother is learning the hard way that no good deed goes unpunished. I would be surprised, however, if the D.A. proceeds with a case where the only evidence is the testimony from a pre-occupied bouncer and a girl who was too drunk to see straight.

In a case like this the bouncers and the night club deserve a major lawsuit. These kinds of bouncers deserve to lose their jobs, and the night club owners deserve a lawsuit that will hurt then where it counts - in their pocketbooks. And the bouncer might need to have some criminal charges brought against him for rough-treating (i.e. assaulting) the girl.

Some bouncers are stuck up and are on a power trip because they happen to have a "little bo peep" job at some chic night club. And some clubs are also stuck up by turning away or kicking out perfectly good customers. These customers have the same dollars as everyone else does.

This is yet another reason why so many people hate night clubs.
