How can I get one state to transfer probation to another state if they seem unwilling at first?

I was on probation in Texas for a simple mis. and was following it to the letter. However, I was jobless, living out of my car for two weeks and starving. My family said come home and we will figure it out. I asked the probation officer if we could tranfer, he said no. I told him I had to go home or I would end up living under a bridge somewhere and probably dead in a month or two. His reply was you do what you have to and I will do my job. So I left for Oregon. I have since called Texas twice asking to have it transfered. One call back saying no, I have to come back to Texas. Why are they being so difficult? I am trying to take care of my responsibilities and they refuse to let me. Its like they get off on oppressing people and that is not what the law should be about. I was turned down for a GREAT job simply because texas has this, now probation violation, on my record. What am I suppose to do when I am not being allowed to handle this to my ability?

In order to transfer your supervision to Oregon, your Texas PO would have had to send the transfer request through the Interstate Compact... Because you're on probation for a misdemeanor, I can virtually guarantee that Oregon would have rejected supervision... Even though it may seem to be reverse thinking, misdemeanors are nearly impossible to transfer from one state to another (primarily, because there are so many of them), while felonies are much easier...

Feel free to read the Compact rules, if you like...

Your Texas PO likely realized the futility of attempting an interstate transfer of a misdemeanor--which involves a hellacious amount of time and paperwork on Texas' end and on Oregon's end--which may be why he denied your request to transfer... I seriously doubt it had anything to do with any desire to "oppress" you...

To answer your other questions...Texas is being "so difficult" because you have absconded to Oregon... You can't expect Texas to be overly willing to do what you want them to do when you have violated your probation by leaving the state without permission... It sounds like your Texas PO made it pretty clear what was going to happen if you were to "do what you have to"... The consequences of absconding to another state should be no surprise to you...

A more constructive approach would have been--prior to leaving Texas, of course--to discuss with your PO any other options you might have, talk to the PO's supervisor and explain your situation, and/or petition the Court to let you move to Oregon or to place you on non-reporting status or to terminate your probation early... You could have also told your Texas PO that you no longer wish to be on probation and would prefer to spend some time in jail, instead, and have your probation terminated... The local jail would have provided you with a roof over your head and three meals a day--thus solving your homelessness and starvation problems--and then you could have moved wherever you want after your probation was terminated...

Now that you have a probation violation pending--and probably a warrant for your arrest--your only option is to return to Texas to get this taken care of... Or, I suppose, you could wait for that warrant to be served on you at a time when it will likely be incredibly inconvenient for you...

If you got probation, it may have been a "simple misdemeanor" but it was a serious one. They are under no obligation to allow you to move. I guess you have now figured out that crime can cause more than a few problems in your life. What are you going to do if they arrest you for probation violation and put you in jail, in Texas?
