Credit Collector Is Harassing, Need Help?


My credit card account was recently sent to a collections agency by the name of Client Services. They haven't contacted me, but are calling my brother 20 times a day asking for me or my number, and he keeps telling them to stop calling. I know I need to pay my bills, but I'm about to have major surgery and will have to work after I recover. What can I do until then to get them to leave us alone? Is there anyway I can also handle paying off this debt without a huge issue or trip to court? I'm only 22 so any help will do, they debt was accumulated from school, but I got in a bad car accident and it has seriously messed me up. Any help would be great and appreciated. What can I do? Thanks.

First of all they are not allowed to contact "anybody" except you. As per the FDCPA, Debt collectors calling outside parties to obtain information on the whereabouts of a person who owes a debt must not reveal that the subject person owes the debt. The collector may only contact these parties once unless the information provided is incomplete or erroneous. Give this bit of info to your brother so he can inform them if they call again. This should stop them cold.

Do nothing over the phone with them, PERIOD! doing so does not provide you with a record of events in case you need it. If they do call you, tell them you do not deal with debts over the phone and that all communication is to be done via mail.

Check to see if the debt is "time barred" in your state. If it is beyond your states SOL, then they have no legal rights to sue you in court. All they can do is "ask" you to pay it. Here is a link to find your states SOL

Your brother can send them a cease and desist letter and accompany it with a copy of something that shows he lives at that address. If they keep calling after that, he can sue them.

First of all, be adult enough to contact them yourself so they will quit bothering your brother. Then work out a settlement or payment plan.

As long as the debt collector is unable to contact/locate you....they are allowed, within reason, to contact relatives. This is called "skip tracing." They can only leave "call back" messages and they cannot discuss the nature of why they are calling.

You have the right under the Fair Debt Collections Practices act to send what is called a "Cease Communications" letter....They are required by law to stop calling....HOWEVER, if this debt is recent and if it's fairly large, sending this letter might provoke more aggressive collection activity, such as their sending you a summons to go to court...so be careful.
