Can I sue over this?


My friend's brother listens to my Mp3 player everyday on the bus. In april i left it with him and he brought it back the next day. I left it with him again and he hasn't brought it back and he has lied to me three times about it. I told his mother through a text and a voicemail and my nana has called her. She still hasn't called back. I haven't told my mom becuz she is going to say well why did you let someone see your stuff which i take responsibility for. My mom paid $250 and i paid $10 for my earphones. Can i sue them for the loss of my property? I have witnesses on the bus who have seen him listen to it even his brother who might lie due to him being family. I tried to handled this without legal action but now I feel if they don't care. I am 14 yrs. old if that matters and how can i tell my mom without gettin in a lot of trouble?

I have had alot of friends "borrow" things from me, through my permission and it took forever to get them back. These are some examples:

1) You call the police and ask them if there is anyway that they can get your belongings back. Just tell them you let a friend borrow your mp3 player (mention the cost of $250 because the police will know its of high value; also more chance of them helping). See what they say and if you have to, beg, because they can force him to give it back to you.

2) You can go to his house and demand it be given to you, and demand that if you do not receive it within a period of time, that you will file a report and go to court.

3) Since the other two would be a little out of reach and lots of work for a 14 yr old, the best thing to do is tell your parents. Just let them know you let him borrow it because "you had a crush on him" but now you learned your lesson and am really sad that he took it and isn't giving it back. More then likely your mom will understand you and she will do the work of contacting his parents and/or the police for all the right reasons.

Don't bother the police over this one. It's a civil matter and they have no authority to intervene.
To answer your question, yes, you could sue in small claims court for the value of the Mp3 player, but you would need a parent or guardian to file for you since you are a minor. It costs money to file a small claims lawsuit, however, and then it costs more money to have the order enforced if the other person doesn't pay up.
Your best course of action is to talk directly to the parents of this person and explain that you loaned your mp3 player and would really appreciate getting it back. Most parents are a little embarrassed when their child fails to give something back to a friend and will pressure their child to do the right thing.
