Is a spouse responsible for a deceased spouse's debts in the State of Alabama?

The house is not paid for. There is very little equity in it but it is in both spouse's names. We have a 2002 Toyota Corolla in which we are still making payments. There is no estate. Very little money left.

If the spouse is not responsible, how does that spouse handle collection calls? Do you send them a death certificate?

If the deceased was either owner or co owner their interests in the property must stand for the debt (that is the purpose of probate) You need to see an attorney and get competent legal advice. You are wrong there is an estate and it needs to be legally settled.
