Help! My boyfriend's daughter is now in the state's custody. Will they grant him custody if he wants her


My boyfriend and I just found out yesterday that his daughter who is 7, has been taken away from her mom. We still don't know why yet (he's calling the detective handling the case today for the details). Anyway, the child is now in the system (very sad). My boyfriend has not not had a very stable relationship with her (seeing her here and there through the years). He doesn't work, and lives with me. What will happen to the child? Will we be able to care for the child (since I work, drive and have a clean record, own apartment). The next of kin would be my boyfriend's mom (she's an elementary teacher). What will the outcome of this situation likely be? What are our options?

It's strange that they didn't contact him (being the father) when they removed the little girl from the mother's home. I would do exactly what your boyfriend is doing. call the detective to find out what is going on. He may be able to go to the case worker who removed her from the home and state that they have his daughter and he would like to care for her. He will need proof that he is the father though, birth certificate or something to that effect.

He didn't have custody of her before? If he didn't have any custodial rights to her before hand, he may have to file for custody with the court.

Best solution would be to invest in a lawyer and try to get custody as you indicate, at least you, are a stable person; better yet, if you and your unemployed boyfriend that you have decided to support get married as that would be a documentedly more stable relationship.

It is optional that the Court would seek to place the child with a stable grandparent unless they specifically petitioned the Court and WANTS custody of the child.

Since your boyfriend is unstable and doesn't have a job, I doubt that they will grant him custody. It is indeed sad (for the child) that she has losers for parents.
