I was involved in a car accident and my insurance company sided against me and for a an uninsured motorist? |
I live in San Francisco so there was no police report. I was half way into the intersection during rush hour traffic in the TL district when the other car slammed into my front end. I was in the far lane and so was she so we both where pretty far (maybe half way) into the intersection when we collided. After 5 months with little word from my AAA insurance company they called me said they made their decision without any of my witness statements and that I was at fault 100%. I still have my car because my agent would not return my phone calls about what I should do with my car( p.s. I have one way ins) and they just got my witness statements in the last month, the accident happened on January 17th. They choose not to use my witnesses because they did not remember details that I do not even remember this long after the accident. I feel that the cause was miss handled but I do not know my rights...Please...any expert comments would be grate : ) How exactly did the accident occur? It's not too clear. Was the intersection controlled by a traffic light? 4 way light? Were you traveling straight through the intersection or were you making a turn? What color was your light? Where was the other vehicle coming from? Where was the impact on the other car? Your lack of detail could be a reason of why they sided with the other person. Most people who are in accidents and truly believe they're not at fault remember the details and can easily describe them.
