IS the attorney looking out to over his a$$? |
we had an attorney represent us for a child support/custody case, adn we found out over time (we received a finalized decree in March, we never got to see draft), through some memos and letters in the master court file, he had received the draft in december, and the opposing atty. wrote in a letter to the signing judge that our atty. verbally agreed to the draft. We found eight to ten significant erros, adn when we brought them to his attention, he told us to get a transcript and file our on modification. He ten told us he had new job, where he not allowed to handle domestic cases. We filed a complaint with our legal grievance board, and he received a copy of it this week. Since then, he's been calling my hubby nonstop, leaving voicemails he'll do anything to "straighten the case"- give us a full refund ($6,000), and fix the errors no charge until we're happy. Because of these mistakes, we are now $7,000 in arrears do to a mistake-filled child support order. Is he trying to cover his a**, and make the complaint disappear (he told my husband he could lose his license, and my husband said 'that's the same thing the child support enforcement agancy is trying to do to me'. Or do you think we should give him a chance to try and fix the mistakes/ (the decree was signed in January, so it's been five months) He is offering the money to correct his errors, not as a settlement. Once the bar complaint is filed you cannot control the result. He knows that. He is offering the money simply because it is the right thing to do. if you're dealing with an attorney, you should get another one to help you with questions regarding that. they were trained on the law. they know more than a regular person does and how to get over or cover their butt. i can tell you what i think but that's not what you need. you need someone on their same level to make sure. sounds like you need a new attorney - why would you take that attorney's advice on what the best process is either on the original matter or the new one? |
