Can I break my lease because reapirs are not made? |
I have been living in my apartment for five months and I have come find out that our air conditioner does not work and it is 80 degrees in my apartment and I have an infant that cant sleep because it is so hot and she has been getting sick. I have contacted the LandLord about two weeks ago and they still have not fixed the air conditioner. I also have really loud neighbors who keep us up all hours of the night and I have called the security about 5 times since I have lived here and they wont stop the noise and I cannot handle it any longer and need to get out 6 months early. I need help on what to do. Read your contract it should say in it what you can do if repairs are not done. Ask your lawyer as well. I'm not sure were you live but here you can have the repairs done yourself and deduct it from the rent. You must provide the landlord with the receipt if you do. Get on the internet and look up the law on it! It's usually titled something like the "Landlord and Tenants Act". Try calling a law office and see if you can get someone to tell you the law. Here in the state I live in, if the rental property is unlivable (too hot, cold, dirty, bug infested etc.) then they usually have 24-48 hours to fix it. Maybe even try to call the police department and see if someone there can quote the law on the situation for you. Look for a state legal department... Keep looking and you should find someone out there that can give you the law!! Best of luck to you and your family! The short answer is yes. However, you should be following up your calls with a letter (and kept a copy) to the apartment manager/landlord. This will preserve your rights and help you remember dates. Thus you can reference all the problems in your notice to vacate and place the burden of proof on him as far as trying to get payment on the remainder of the lease or not returning the security deposit. You need to have all your requests in writing. Send a letter, CRRR, to the landlord...outline your repairs requested as well as the problem with the noisy neighbors. Give him a certain amount of time to correct the situations. That should get his attention. Also, double check your lease to make sure that you are not responsible for repairing the A/C. |
