How should I handle this credit issue in California?

I had a repo 10 months ago and I had owed like $6500. It was a car I know that Premier Auto Credit (Auto Finance Company) could've easily gotten $4000-5000 at an auction. From my understanding, if they sold the car aren't they supposed to deduct that from what I owed them? Is their a legal ceiling on what fees can be charged or added on in California? When I checked my credit report, the balance was $6500. So what should I do in this situatioN? I was thinking about calling them and finding out if they sold the car or not? Because if they did and didn't deduct their recoupable earnings on my balance and reported that in their financial records isn't that a violation of the FDCPA? Meaning I can get that record removed if I contact the credit bureaus or the FTC?

They can sell the car for any amount a auction. It does not have to be the actual value of the car. The bank could not care less. They can always come after you for the difference.

I don't know all the California bankruptcy laws, but it does sound like you know what you are talking about. You will definitely have to be persistent, be professional though. They did get their car back so I would imagine they wouldn't be too upset at you.
