In an old court case can the defendant call the petitioners attorney and request the court docs?

I just found out that I have an eviction on my record from 6 years ago from when my then husband got called to Iraq and we had to leave the apartment they "evicted" us from a month later. I never recieved any summons to appear or any notice of said eviction and neither did my exhusband. I called the apartments attorney who handled the case and they are saying that I can't look at their court papers until they get permission from the apartments. But don't they legally have to furnish all documents to me as I am the defendant?

Oh and i should mention that I am wanting to find out who sighned the summons to appear. Cause whoever did it lied. I can't find a place to live cause of this eviction.

You can get a copy of anything they filed from the court clerk.
It is public record. As far as their files no, and I wouldn't count on them giving the court papers as you can go get them yourself.

Daisy is right. Go to your county courthouse and ask the clerk to look up the records. You can usually view them for free and can get a copy for a small fee.
