Advice on handling this situation?


My ex fiance and I went to the furniture store and I helped him co sign as a secondary person. (which was STUPID, I know).Then he cheated on me several times and we broke up. The furniture is currently in his possession. He stopped paying the bill Dec. last year, now the credit card company keeps on calling me daily, I have asked, pleaded and even begged him to take care of his responsiblity. Every time I call him he tells me not to pick up the credit cards company call. I ended up picking up the payment but with the amount of furniture bought it would probably be 4-5 yrs before I am done. Secondly I don't like paying someone elses bill
This is like a BURDEN on me.... A friend recommended a small claims court but right now I have a very busy schedule. Does any one know how long it is before ur time to file a claim expires?.. Or I was hoping since I have paid the bulk of the bill, if I could go pick up MY furniture. Any advise would be appreciated tremendously

If he refused to pay, your only recourse is to take him to court. All states have "Statute of Limitation" SOL on debts. For your state's SOL check the link below,

You might want to remind him that once you obtain a judgment against him, it becomes a public record and will show up on his credit report for the next 7 years. (Maybe that will be an incentive for him to pay up).

Going to court is your only option, since it sounds like this guy is a real ba$tard, relying on your concern for your credit rating to get free furniture. I don't think there's a time limit - unless years have elapsed or something. You could hire some jack-booted thugs to go over and retrieve your furniture that you paid for, but he might not like that.

Carol, your only option here is small claims court.

Yes it's a hassle. But depending on how your local court works it's not going to take more then a few hours to go to court.

I'm going to bet that once he gets your complaint/summons he will cough up the money anyway. The last thing he will want is a judgment on his credit history.

sorry, but since it is in his possession, only way you are going to get it is if he gives it up (yeah right) or court
