Suspended Drivers License?!!?!?

Back in April, my husband got a no insurance ticket. He had insurance, just didn't have a card on him at the time. He went to court in June for it to have it dropped, and everything was taken care of. Tthe States Attorney was supposed to forward all of the information to the DMV to make sure his license wouldn't be suspended.
On his way home from his buddy's house, he was pulled over and informed that his license was suspended for no insurance. He explained the situation to the cop, who said it didn't matter, he still had to take him in. Which also resulted in our vehicle being impounded. He bailed himself out, and is on his way home now. My question is, what do I say when I call the States Attorney's office tomorrow? His dad is going to get our car out of impound tomorrow, to avoid any daily fees that may occur. But will this be reimbursed? We've never been through this before, and it's ridiculous that we have to pay the price for the states screw up. What's to expect in the future?

Yeah we aren't looking to get rich quick. All I expect is to be reimbursed for his bail money and the cost of the impound. I do have papers stating that this was all dropped last month so I think it was a lack of communication between the dmv and court house.

I once had to go to court for a speeding ticket. As it turns out the officer sent me to the wrong court, and the judge reduced the charge to compensate for my inconvenience. Somewhere on its way to the DMV it was recorded as Reckless Driving!!! They were going to suspend my license. I found this out the day before having to be deployed for 2 months!

I called the court and spoke to the judge. He remembered the case and took care of it.

Perhaps you can get this straightened out through the court on your own, before you go off and get a lawyer to file a lawsuit for you.

Maybe he should have had the insurance card on him in the first instance. Lesson learned.

That sucks

Calling the States office isn't going to help a whole lot. It might inform them that they made a mistake. But unless you have documentation from the court from when he went to prove that it was dropped your screwed and have to pay. The officer is doing his job as any officer would. What needs to happen is you need to file a lawsuit in federal court for wrongdoing. That will get the district attorneys attention. They don't like to have blemishes like this on their record when they have to be elected. Just call the state office and explain what happened. If your not satisfied with the results sue them. That will show them that you won't take this lying down. They will then in turn call you repeatedly and try to fix the situation before it goes to court. You will probably get a sizeable settlement (if your in the right) and they will be asked to leave office. Because the State usually can't afford to pay you for a mistake.
