We have this lawsuit against a company called Lucore (they own Jiffylube) can u read this...?


Ok, my mom's boyfriend works at Jiffylube, the first jiffylube he was racially discriminated, and we got a lawsuit for that, he has hard proof on his phone, what the guy said, and he has hard proof that the guy admitted what he said (he recorded it). And the lawyer said this case is a done deal, were looking forward to at least $500,000 on this, but then something else happened at his other job (they relocated him) this woman sexually harassed him, now keep in mind that these are employees not customers, and the girl was caught on tape, and we got a lawsuit for that as well. but Lucore doesn't want this to go public. so their shooting him deals like $10,000 or $50,000 but u know we want the big pot, my stepdad is telling them basically, "if you don't give us what we want, then this is going public." so we gonna let it ride out, but i wanna know how long are we going to be riding for? how long will it take an average for this kind of stuff to end? any attorneys or lawyers out there?

Each case is different. Lucore probably wants to settle both together, but if it were me , I would have two separate lawyers handling the cases SEPARATELY!

Generally, once a COMPLAINT is filed in court, it has to be served to the defendant, or if it is a corporation out of state, the Secretary of State serves the complaint to the registered agent for the company in the state.

The defendant has x days (normally 30) to file and ANSWER. Your attorney should be providing you with a copy of the complaint and answer. Once the defendant files his answer a hearing will be scheduled to hear motions and schedule a trial date. This is when Depositions and Discovery Motions take place.

Most likely when the defendants attorney hears the voice recordings they will make a settlement offer to your attorney, maybe not. They could try and have the evidence removed.

If you agree to a settlement, you will be asked to sign a "gag" or confidentiality agreement not to talk about the case.

YOU DO NOT HAVE TO AGREE TO CONFIDENTIALITY!

Then you can go public.

Ask your lawyer...they may want to go public right away to pressure a big payout. Good luck.

civil matters can drag on for several years. there is absolutely no way to determine how long it could take.

make sure your lawyer has actually FILED a claim not just threatened to do so, as there are limits to how long you can wait before you file.

In civil law suits, it can be as quick as a few months to as long as several years. A lot has to do with whether the company is willing to settle with you, and whether they are in a hurry to clear up this situation....due to bad press (PR).

Most of the time, they will drag it out. They have attorneys on on staff, so it doesn't matter to them how long things go on.

You should find out if the second event (something else happened) was in any way related to the persons who work at the Jiffylube.

Were the people involved [in the second event] friends, customers, or relatives of anybody who was involved in the first lawsuit. { Could they belong to the same club, organization, or civic group (such as the Chamber of Commerce)?????

Could these two events be related in some manner { perhaps in an attempt to discredit your claims in the primary lawsuit}??????

You should talk to your attorney about the above possibility.

If you are looking to go to court you may have the wrong attorney. Most attorneys are inclined to settle rather than go to court. Remember too that nothing is guarentee in a court of law as to the outcome!!!!!!!

If you feel your rights were violated, and you want to go to court, an let a jury decide, I wish you well, and a good jury!!!!
