Unlawful Garnishment?

So three companies all lined up to garnish me. The first company served me papers years ago at a different job.

After the first two paychecks of the garnishment my boss told me they sent the checks he sent the company back stating they had no judgement.

So I asked my boss for the money back so I could eat and live. He said he had to hold them until he heard from the company what to do.

I contacted a lawyer and filed bankruptcy. My lawyer asked my boss to cut me a new check. It has been several paychecks later and I am still being garnished and our accountant says the checks are still sitting with her.

My lawyer has contacted them several times. My boss told me he forwarded the calls to our accountant who is also payroll. Why is she still sending out my garnishment? Why can't I have my money back? Why is my lawyer unable to help me even with the "stop" due to bankruptcy? What do I do?

In my state once you file it is called a stop meaning all collections must STOP. Also since there was no judgement against me my work has no right to hold my money nor does the company that did not go through the proper channels. I am wondering why my lawyer is unable to help me when there is a stop right now.

You have to go after the company that is garnishing your check. When you file bankrupt your suppose to list the companies. If they do not stop the collection then file that against them in the Bankrupt court case. It's a contempt of court charge. There have been cases when the companies paid back the debtor and interest, then cancel the debt. Good Luck

until a judge approves your bankruptcy,they will keep coming after you,and only a judge can decide if you are bankrupt or not,a lawyer cant.
