I was in a Car accident 6 months ago and I am still waiting for money owed to me....i need help?!?

I was in a car accident 6 months ago and heres the story.......My car was totaled. not my fault. driver at fault's insurance settled an amount with me. The amount was paid towards my loan. It covered the balance and I was given a refund check. Fast forward 3 weeks. Get a call, they tell me every thing from Nov on is appearing as a bounced check.. including my payment I made that came from my checking account, the settlement check for the balance and 3 checks from the company i bought the car from because of warranties...fast forward another two weeks... they tell me 3 different stories, finally talked to supervisor who told me everything is fine....BUT ITS NOT!!!...stupid loan company sent me a check that my car company sent them for a warranty towards my account, the account was closed already, so they sent me the same check, not made out to me. I contacted the car company and loan company neither said they can do anything ........WHAT CAN I DO!!???!!? Please help!!

In reference to the details I had left before with this question, I did settle with the Insurance company, also the checks that were bounced were due to the Loan Company's mistakes, not mine. The situation at hand is the car company was slow to issue refunds for all my warranties, the last one was the GAP insurance warranty. This was the check that was sent to me from the Loan Company, who had received the same exact check from the Car Comp.. The reason the Car Comp. sent the check to the Loan Company was at that time the account was still open. Loan Company received the check and realized the account was all paid off, so they forwarded the check to me, THE SAME CHECK MADE OUT TO THE LOAN COMPANY, NOT ME! Now when I contacted the Loan Company they told me it was the Car Comp's problem, and when I called the Car Comp, they said it was the Loan Company's problem. Neither could do anything for the large amount of money in a check that I had no way of cashing. This is what I need help with

Contact your insurance agent, tell him what is going on, and have him intervene on your behalf with the other company.

call your states insurance complaint dept tell them this storie also get yourself a really good lawyer you will need him, what does your insurance company say, put pressure on them was there police called to the accident and a report made? the person that hit you wont be hard to find google them they are also under the freedom of infomation act track them down get the lawyer to this work

To all those dummies that suggest you complain to the insurance commissioner -- why? The insurance company met their obligation by paying you a settlement -- which you accepted. The fact that you are bouncing checks and have loan company foul-ups aren't the fault of the insurer.

Find the address of your state's insurance commissioner. Write him or her a letter detailing whatever you said above...but you might want to be a little more clear. What you've written is hard to understand. Just give the time line and try to be dispassionate about it, i.e., don't say "the stupid loan company" -- that will get you no where.

The insurance commissioner will investigate and if you are due any money or assistance, it will come through the commissioner's actions.
