Car hit mine and he won't admit fault.?

I live in California. I came out of work last Wednesday and saw a car touching the back bumper of mine. I moved my car forward and found out I had some dents and scratches left my license. I didnt contact the police, because they were minor so I just left a note. It's almost been a week and after some phone calls he says he didnt do it, and even that i may have backed up into his car. I didnt take any pics of the cars touching, should i just file a police report anyway, today? Is there a distinction between damages set by a car backing up into a car or a car hitting the back of a car?

Its gonna be hard to prove if there were no witnesses. #1 call the police and see what they say #2 take pictures of your car and if possible the other person's car (damage of scratches and dents to each car) #3 get an estimate of the damages

It is going to be hard to prove who hit who's car unless there are witnesses. If there's paint transfer.... it will still be hard to show if you hit the other person, or if they hit you.

Depending on how much damage there is to your car, it may be worth it for you to have it fixed out of pocket. If the damage exceeds your deductible for collision coverage on your auto policy then you can put the claim into your insurance company. Keep in mind that the claim will be on your record if you put it through your insurance company (UNLESS he accepts fault in which case you can go through his policy to have it fixed.... or you go through your own and your insurance company subrogates against his).

First, try to report it to the police. Second, did you have any witnesses? Do you have an estimate of what it costs to fix the damage?

File it in small claims court. Let the judge decide who is at fault.
