Any chance CarMax will take the car back?

I bought a 2004 Saturn Vue March 5th from CarMax. Within 3 days I noticed the car would suddenly jerk when accelerating on the gas pedal from a stop sign or red light and thrust me forward. When this happens I press down hard on the gas pedal and it would not pick up speed just coast for a couple of seconds and then go back to normal. Carmax took it to Saturn and they said the transmission fluid was contaminated and flushed the cooler lines. Car worked okay for 2 weeks and now the problem is back. I'm a single mom with two babies and I can't have them in an unsafe car like this. The jerking is so hard it scares the crap out of me.

There is the 30 day warranty. Any chance I can get them to take it back and maybe work something out to get another vehicle? I've called and left a message with the CarMax Customer Relations Dept. 1-800#.

The 30 Day warranty quotes says "In the event CarMax elects to accept return of the vehicle, Customer will receive a refund of the purchase price paid less the Use fee."

I'm just hoping they don't tell me again they couldn't duplicate the problem. They take it for 1 test drive and say the vehicle is fine. I drive it 40 miles everyday and know something is really wrong with this car.

absolutely, you can take it back and get something else, with the 30 day warranty they have to honor it

what does the warranty say? is it for repair or replacement?

I am sure they will especially since you took it to them with that problem after only 3 days. You have proof that the problem existed and you notified them of it. Worst case bring up the better business bureau to them but only as a last resort.

If you have a 30 day warranty....go for it...plus you can take it back for an upgrade with no loss of money you paid them.
