What can happen to my friend? Nude cell phone pics and firing.?

My friend sent out a nude pic of herself to three exes over Christmas. She works at a store that is nationwide. She got a call from another employee in the neighboring town saying they had received the pics on their cell phone. She is worried about losing her job because on one of the forwards they added who she was and where she works. I told her that if she is fired, she has a lawsuit over wrongful termination. Can she lose her job for this?

This is why you should never send out a picture you would not show your mother.

Most national companies would not fire you for this, but if they felt like it was putting the company in a bad light, they could. As for wrongful termination, chances of winning would depend on where you live. If she did not include the company name in her original message, but it was added by someone else, that would help her case.

uh...most states have at will hire and fire; they can terminate lawfully for just about any reason up to and including, "we aren't happy with you" Odds are she is worried over nothing and unless the pic's were porn, anyone at her store will probably just share them with the whole place and let it blow over.

If she sent them to company execs, especially over company computers or phones, there is certainly grounds for termination. Pretty stupid.

Some companies/organisations believe that what people do in their private live does not matter so long as it doesn't affect the company/organisation.

The main mistake is that your friend added where she worked, and thereby used the company's name in conjunction with the picture. That automatically involves the company, and would be grounds for immediate termination by my book. The company could also press charges, so tread carefully.

She is not the sharpest tool in the shed is she?

the answer is perhaps - Where she lives and what kind of work she does and for whom and if she signed an employment contract (morals clause) would all play into a termination decision

You are wrong. She can be fired and she would not have any grounds to sue for wrongful termination.

Most states are 'at-will" employment, but doing anything that the company feels tarnishes/is not in line with its image is grounds for justifiable termination. If she works for a strip club, they might be ok with it but if she works at a bank, she should start looking for another job now.

Have you both not read in the news about the aspiring teacher who was not issued a teaching diploma by her university because on Myspace because of a morales violation because there was a picture of her holding a plastic cup entitled "Drunken Pirate" on Halloween? She is trying to fight it, but she will lose. Same thing applies here.

What an idiot. If she doesnt loose her job she will be lucky.They might not say, they are firing her for that reason, they can fire her whenever they want if she has no contract.
