By law, is a civil contempt order of incarceration to be lifted after compliance? |
During a divorce decree a friend of mine was ordered to pay an ex-wife $20,000 at $300.00 a month.He has paid over $10,000 in the past 8 years. She disappeared for two years, no forwarding address. She came back and filed a contempt order. The judge ordered he be incarcerated until he paid the $10,700-impossible. He was jailed for over 6 months, then released to work release. For the past 3 months he has paid $100 a week. By law, shouldn't the contempt order be lifted and he be released from jail, as he has complied with the original order. This is NOT child support. They were married for 4 years and have no children together. This has been going on for over 8 years. He can't afford an attorney, and by law, since it's a civil case, he is not entitled to one. For over nine months he has been in jail for what is basically a debt. In the USA where you don't go to jail because you owe a debt. He went to court today, she called and couldn't make it, so it was postponed again. Gwinnett co GA An appeal of the order should be handled according to Georgia law...by a Georgia attorney. |
