Minor Fender Bender. Exchanged info, no police report. They want $3000 or to sue.?


I have full insurance coverage. It was a rainy evening & I was stopped behind a car at a stop light. I thought she was turning, so slowly rolled forward but I bumped into her. We pulled over. I had NO damage to my car & she had a very minor scratch on her bumper...maybe even nothing, but it was pouring rain & hard to tell. She told me "don't worry about it, its nothing". But, we exchanged names, phone #'s, & addresses anyway. She didn't call me until 10 days after it happened. Actually, her boyfriend called me & left a message saying the damage is over $3,000 & I need to pay ASAP or they're going to sue me. I called back & left a message saying I do not have that kind of money & we will need to go through insurance. Now, it has been another 10 days & I just heard back from them again. They left a message saying I cannot go through insurance because it will be a major point on my record & to pay $3000 or their lawyer dad will sue. What should I do at this point?

Call your insurance company and let them deal with it. That's what you pay them for.

GO THROUGH YOUR INSURANCE. They're intimidating you because they don't want you to use insurance because then they'll have to prove there is actually $3000 worth of damage.

They are trying to scam you. Get in contact with your insurance agent ASAP and tell him/her what is going on. They know they do not have $3000 worth of damage to her car and tell them they will have to prove it to your insurance company since the woman said not to worry it's nothing.

Contact your insurance. They can't sure you if they refuse to report it to their insurance company. You're fine, they're just bluffing.

They can't sue you if there was no police report. You were never there. What accident?

That's is why you always get a police report, the world is full of money sucking freaks out there, call your insurance NOW.

Since no police report was filed, they do not have too much to go on. Just tell them that you will not pay them, but if they want to try and collect from your insurance, give them your agents number. The insurance company has lawyers as employees that handle these kind of things every day.

don't give them any information or acknowledge any guilt, just say it will have to be an insurance matter if they want anything from you.

do not pay them-let them sue you-make sure you keep records of their threats-just in case. I doubt they will-they know they probably will not collect-good luck. Why is the boyfriend calling (money hungry)

Ok first do not panic. if it was a small fender bender, thy are just trying to bully you.
If thy sue you in court the judge will say why did you not talk to the insurance . it sounds like a scam and if you did'nt see any damage, as them to send you and estamit of the damage. and you will turn it into your insurance.
DO NOT PAY THEM A DIME. That is what your insurance is for. Most likly if it was a scrach it is not gonna cost 3000 to get it out.

first of all, it is a scam!! if there was no police report and you didn't turn it in to your insurance company right away, then it never happened. tell the idiot that is sending you messages that you are turning it into the police and they will handle it for you. that will stop all that other bullshi-- tell them that they left the scene of an accident and you reported them for it. scare hell out of them. thats what they are trying to do to you.

I agree with Ribuckeye...there's no proof the accident ever happened. If they call again, call the cops and tell them some psycho is harassing you and trying to get you to hand over $3,000. There isn't a scratch on your car...never happened.

what accident ? show me the report. unless you wrote the info for them (handwriting) tell them to have a nice day and give them the hawaiian single digit peace sign. if you wrote the info--GET YOUR INSURANCE INVOLVED.

Contact your insurance company and let them deal with it. They have claims adjusters and lawyers to handle this.

Check with your state's dept of motor vehicles and find out the $ limit at which you are required to report an accident. In Calif, the limit is $500 or more. You may have to file a police or DMV report.

If you want to get nasty, contact you own lawyer to see if they will write a letter to the other driver, telling that your lawyer will write a complaint to your state's bar association about the other lawyer's blatant misconduct. That will cool things off a bit.
