Which Presidential candidate is for tort reform? Can we fire all Congressmen until tort reform passes?


The saga of tort reform bills in the U.S. Senate continued Monday and Tuesday, as Majority Leader Bill Frist took a U-turn, first intending to bring the Class Action Fairness Act to the floor for a vote, then backing off as Democrat supporters of the bill balked at Frist's intention to move the bill forward. The Act is intended to address the phenomenon of large national class action cases being shopped to the most permissive jurisdiction in the country -- inevitably a "magnet court" favorable to plaintiffs -- by allowing for such cases' removal to federal court.


The "magnet court" phenomenon is certainly real, as admitted by plaintiffs' lawyer extraordinaire Dickie Scruggs: "[W]hat I call the 'magic jurisdiction,' . . . [is] where the judiciary is elected with verdict money. The trial lawyers have established relationships with the judges that are elected; they鈥檙e State Court judges; they鈥檙e popul[ists].

They鈥檝e got large populations of voters who are in on the deal, they鈥檙e getting their [piece] in many cases. And so, it鈥檚 a political force in their jurisdiction, and it鈥檚 almost impossible to get a fair trial if you鈥檙e a defendant in some of these places. The plaintiff lawyer walks in there and writes the number on the blackboard, and the first juror meets the last one coming out the door with that amount of money. . . . The cases are not won in the courtroom. They鈥檙e won on the back roads long before the case goes to trial. Any lawyer fresh out of law school can walk in there and win the case, so it doesn鈥檛 matter what the evidence or the law is."

The courts have become a fashionable way for lawyers to redistribute unearned wealth to themselves. Obviously Mitt and Rudy realize it's out of control; but John Edwards would have been earning minimum wage all these years flipping burgers (or doing Breck commercials) without confiscatory legal practices.

As far as firing all Congressmen, there are a handful of very capable people we should keep. Lundgren, Paul, and a couple of others. We might have to create "make work" jobs for the rest, but then, that's what we're doing for them now, and the jobs are very expensive, accomplish nothing, and drain us of our money and liberty.

So go for it.

I never saw an HMO that was willing to give up its ability to sue you although you must give up your ability to sue them when you sign with them.
There must be something to it if they want it all for themselves.
