How do I sue someone in another state?

I had purchased an item in August that was sent to me in September and was of poor quality and not what I asked for. I sent it back and the woman said that she would fix it and send it back with in 6 weeks. She NEVEr sent anything and stop responding to emails. Her website even had the number as be serviced. It is now April and theonly time she responded was once due to me sending an email saying I will have to sue if she does not handle the situation appropriately. She sent something back claiming that her business was under going changes and that the item would be shipped. I believe she lied because she claimed she allowed others to make the order and they messed up and that was why it wasn't sent. But, she never told me that before my email.

Oh BTW - I paid $850.00 for the item.

Simple. If you want to hire an attorney, hire one in that state, preferably same county and city.

If you want to do it yourself, go on the website of that county's clerk of courts, download the form for complaint, usually called "Complaint Form" or something along those lines, fill it out and send it in. They will let you know when your hearing will be.

EDIT: I just noticed your edit - you will have to go to small claims, most likely, and attorneys aren't allowed in there. You can still hire one to assist you and manage your case.

Yes. However, it will most likely have to be in Federal Court because personal jurisdiction is different. An appropriate Circuit Court could have jurisdiction.

There may also be a minimum monetary requirement involved.
