My Landlord increase my tripple net how i can stop him?


Tripple Net is the expense of the common area maintainance which landlord charges each tenants along with the rent well in my case i pay $400.00 per month towards tripple net with my base rent but recently he told me that my tripple net is increasing by $176.00 per month . Well as is my business is not going well i hardly can make the rent money how i can bare the increase he also told me that any corperate store in the shopping center he is not charging any increase only mom and pop store have to bare the cost of increase and as the ma
I therefore request any person who can help me to write a letter to my landlord regarding the increase of the tripple net .

P.S.
He has hired a security guard who does everything for my landlord which includes cutting the grass of the entire shopping center ,clean the parking lot and do the security work for the shopping center . and last year he has spent $155,000.00 on 64000 Sqft. so each tenant gets $2.34 per sqft .

I would check your lease to be sure what he is doing is legal. I would also consult a lawyer to see if he can increase only "mom and pop" stores and not the corporate accounts. Seems like he is not increasing corporate tenants because they likely have something in writing prohibiting them from the increase. Doesn't seem like it would be legal to increase some and not others unless it is written in your rental agreement or lease. What did he spend the $155,000.00 on? Grass cutting, etc? Little extreme if you ask me. If you can I'd relocate!

Most leases require an increase in triple net expenses every year. If triple net was not defined in the lease as a set per-square-foot amount in the lease, then triple net can go up anytime proper notice is given.

Do consider your landlord's expenses are increasing very fast: property taxes and other taxes, utilities, hiring the new security guard. Some places property taxes have increased 20% or more in just the past year! Your triple net is very low.

If you are barely making it now, you are going to have build up your biz to cover your costs.

Unfortunatly these are fees that your landlord can set up at his/her disgression unless you have a contrct with him/her that states otherwise. You can talk to your landlord about holding off on the raise of cost for a few months with an explanation of the economy and the worry for your company. However, most landlords will not care about this, either you pay or get out. I would start looking for other locations to rent and see if your landlord is willing to work with you on this one.
