Better Business Bureau?


I had a contract with a fitness center that i signed for a year. The center changed owners in February and no longer offered the classes I was taking during my available time frame so i spoke to the new manager and asked for an early contract termination. He said no problem and i signed the paperwork. The owner said it would take effect in May and I would no longer be debitted on my account. Come to find out my account has still been debitted each month and the fitness refuses to help. What should I do? Who should I contact?

To get results and your money back, you should also file a civil suite against the company.

why is the fitness club not agreeing to stop debiting your account? they should do it immediately after they find out theres a problem. i would insist. if they dont call the bbb and they can help you get that money back if you have proff that they agreed to stop debiting your account. just look it up on your pc. its not hard

My thoughts are to first contact your bank and see if you can terminate that aspect of debiting from your account. Look into your local legal self-help centers to see what your rights are, because from what you have described, they have breached their own agreed contract with you. Once you signed the additional paperwork, stating to end/terminate services and they agreed with this and signed the paper work as well, with the two of you having your own copies, it does appear as though they breached the contract. But do read the fine lines in between and contact your local BBB, make an online report. Also try sending them a certified letter in the mail requesting your money to be refunded within 10 days of receipt of that letter and let them know you are prepared to take them to "Small Claims Court" where they will have to cover all and any cost for filing, etc. See for yourself on how to do that via the links listed within the sources. How do you pay?

If it is a credit card, you will probably have to cancel it and get another card number.

You have to have it in writing from them that you could cancel or you are out of luck

I would speak to the owner directly.
