My 17 yr old bro got arrested in CA. for poss of illegal fireworks can I fight it since he is a minor?

On July 4th undercover cops arrested my bro. for poss of illegal fireworks. We told the officers he was a minor 17 yrs old. My brother also told them he was 17. But they still handcuffed him and took him. They said they were going to book him and release him after 5 hours. I asked the officers for their business cards to verify they were legit officers since they came in a white van w/o license plates. I wanted to verify they were real cops. They said they didn't have any cards. They told us they would take him to the station. My father & I immediately went to police station. The front clerk told us he wasn't there. He said all violators were being taken to a community center. We told him my bro is a minor. We gave him my bro info. He said minor only get cited not taken away. Arresting officers said my bro said he was 18. Lies. They said they 'd bring him home right away, since he was a minor. He was cited once they dropped him off. Can minors be handcuffed? Taken away to get booked?

The are things that you have to do with minors a little different then adults. But a lot is the same, and states vary on how to handle things. Can they be handcuffed?, yes they can. Taken away?, yes. But a lot of times you can be cited for certain offenses. And I guess there may of been the possibilty that your brother was wanted for something more then just the fireworks. He just gave the Police a reason to pick him up with that.

As already stated above Minor's just like adult can be arrested and thrown in jail, also in today's world Minor's close to 18 like your brother can not only be arrested can be tried as an adult

as long as the person is over 16 years of age, they can be arrested. trust me on that one, i got into some trouble when i was 14 and they didnt arrest me cuz i wasnt 16 yet. ur bro can def. be arrested at 17. at 17 a person can also move out and be on their own. 17 is a very strong number since kids do graduate from high school at 17 b/c they're born late in the year. u cant fight it, actually, the cops are more right then u are. he's 17, why does he have illegal fireworks? ur father can even get arrested for that. good luck man.

Yes at 17 when you get arrested and go on trial the judge will decide wheather you will be trialed as a minor or an adult depending on the crime. Whatever age your brother told them they can't take his word for it and they must look him up with his social security number.

call the cops...oh wait they are the crooks. Cops suck. Why didn't they just confiscate the fireworks and cite him anyways...even if he was over 18. It's because cops are jerks. They wanted to let you know they were the boss and it is attitudes like those that makes the public hate cops.
