Is it expense deductible for a company ?


Hi,
This is my issue which is a bit bugging me.
Say, there is a small sized company which business address is on residential property, not on commercial address.
Even in this case, can the company claim the rent fee on residentail property as a rent expense ?

If your personal name is on the residential lease you can sublet to the company and invoice the company for GST free rent. The company can claim a deduction for its rent expenses but there will be no GST credit. You should base the rent charged to the company on a reasonable commercial basis for the floorspace area, i.e. what a business at arms length to you would be expected to pay. Document any information and workings regarding this estimation.

Edit - yep, what Hubert said too - there has to be a separate place of business which is not used privately or domestically. For example, a house which is separated into a doctor's surgery at the front of it or a separate room used solely as an office. Keep this evidenced on a floorplan which can be easily provided to the ATO should they ever inquire.

The ATO has always been a little 'thingy' about rental or other expenses, in relation to residential properties.
You would have to show that a part of the residence, ie a separate room, has no other use other than for business purposes. It is not sufficient that the business is conducted from the residence. For rent or interest to be deductible you must be able to show a distinct 'office' or business premises.
The use of part of a room or such is not deductible.
You would also have to show that the company incurred and paid the expense. If it is your residence that may be difficult.

If it is a home base business, the office space may be claimed. My husband is an independent contractor based out of our house. We use Turbo Tax and it runs us through the process.

your rent can be claimed as a deduction, but apportioned.

roughly speaking...say there's 3 rooms in your house and you use 1 of them as an office for your business, then 1/3 of your rent can be claimed as a deduction on your business.
