Someone is threatening to call a lawyer ... (serious ?)?


My husband owns his own business, working with trees. A few days ago he gave someone an estimate to cut a few dangling, dead branches out of a tree. Here's the senario:

The tree is actually on the property of 162 (address), the lady who called lives at 160. The lady at 160 told my husband that she had spoken to the lady next door, and she said it was OK to trim the tree. My husband did NOT get anything in writing.

So, he trims the tree, and now (2 days later), the lady at 162 called the business and left 2 very rude, nasty messages telling him he killed her trim and she's calling a lawyer, because he did not get her written permission to go on her property and cut her tree (which she says she loves and is irreplaceable)

My question is this ... is he screwed? I have a feeling the answer is yes. He didn't get anything in writing from the lady who wanted the work done, he only has her word.
Second question ... if he did want to write up something for people to sign (more)

in situations like this, does he need a lawyer to look it over (as it would be a contract?) or could he just write it and have people sign it? Thanks in advance!

I own a small business, and if he cut down on a tree on without the property owners knowledge, then yes he is liable. But no judge will ever "put it to " him. He might get hit with a thousand or two thousand dollar judgement.

he can write it up on his own, but it would be advised to have a lawyer look it over.

Yes, he needs a contract and he should be bonded and have work insurance and he does not have the right to trim trees without a contract. This same situation happened in my parent's neighborhood and a tree cutter was sued for the way he trimmed a gorgeous oak tree. I think it is important to trim a dead branch but not destroy the beauty of the tree.

Yes, screwed. You have no right to do work on a persons property without their consent.

In situations like this all he needs is the property owner to sign the work order.
