Went to visit jail, was told there was a 16 yr old misd warrant for me. I have a clean record.? |
I was given a citation and told to appear in court next month. I was never served and can only guess what this is for, an assault charge from an ex alcoholic spouse. I put charges on him, got a divorce and never heard regarding the matter. I have state licenses. I have never heard from DMV, my background was checked for adoption 3 yrs ago, I've gotten clearance to visit people in prison as well,this has never come up. I have never been arrested or in trouble. Do I need an attorney, or just explain all this to the judge myself when I go to court? Do you recommend I go to court prior to this to resolve? This man is remarried twice since then and put charges of assault on his wives and mother, he is sue crazy. I have had the same address for 20 yrs. Please help, I am a nervous wreck. I dont want to be arrested or lose my reputation, don't want a blemish on my record, or lose my business. I'm sure you have nothing to worry about. First because the statute of limitations has run out on almost any crime except murder. Second, if you ex has a history of falsely charging people the judge will see it for what it is and dismiss all charges. Probably nothing to worry about, but I'd definitely call an attorney and have him check into it - don't ignore it, whatever you do. I'm sure once you explain everything (and hopefully have some sort of proof regarding your ex) you'll be fine. I think you need some legal advice. Call a local attorney. Your better safe than sorry! Hire a lawyer. Hopefully this will resolve itself quickly but it's better to have one who knows the system helping you. Even if you dont NEED an attourney, the judge may see it as a smart move to show up as professional, and prepared as possible. I truely wish you good luck in your situation. Sorry I cant offer more help. Warrants never expire. I would not be concerned about a 16-year old misdemeanor warrant, but it would be in your best interest to show up in court. However, consult an attorney first. take your attorney just in case. you never know what might happen! you have to answere to the judge. no you dont have a clean record |
