Agreement/Contract with employer?

Dear Sir,

I am employee of an organization named ABC Pvt Ltd India and it has a sister company called XYZ Pvt Ltd India. I am looking after both the company for past 1-1/2 years. I joined this company in June 2005.

I'm working as Manager International and recently company asked me to go to a foreign country for marketing of its product, on the same day of my flight they asked me to sign a contract for a period of 2 years and I was literally forced to sign it as there was no option for me left.

I was afraid of being terminated from job and so I signed it. Now after coming back I found that the contarct is made under its sister concern XYZ Pvt Ltd and not under my employer company ABC pvt ltd, India. Both the offices have different address but the management is same.

One terms & condition mentions that in case of breach of contract I've to pay 5 Lac rupees and also I can't work for any industry which is having the same business or so for a period of 2 years.

It's not clear what your question is. Are you looking for a way out of the contract? Do you feel you were coerced into signing the contract?

In any case, you will need to consult an Indian attorney to review your contract. It's impossible for any stranger here to give you any substantive advice without having access to the contract language.
